These Terms of Use (“Terms”) govern your access to and use of Nursing Home Reporter at nursinghomereporter.com and related pages (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Who we are

Nursing Home Reporter is an informational publishing and lead-intake website. We are not a law firm, are not a substitute for an attorney, and do not form an attorney-client relationship with you through this Site. Submitting an intake form does not guarantee that an attorney will contact you or take your case.

2. Informational purpose only — no legal, medical, or professional advice

Content on the Site — including facility report cards, ratings, deficiencies, penalties, staffing figures, rankings, “neglect signals,” quizzes, and commentary — is for general informational purposes only. It is not legal advice, medical advice, or a determination of negligence, liability, eligibility for a claim, or the quality of care at any facility. You should consult a licensed attorney in your jurisdiction for advice about your situation, and appropriate medical professionals for health questions.

3. CMS and other public data

Much of the facility information we display is derived from publicly available U.S. Centers for Medicare & Medicaid Services (CMS) Care Compare / Provider Data Catalog datasets and related public sources. We may transform, aggregate, score, or summarize that data (for example, “worst homes” rankings or neglect-signal lists).

  • Data may be incomplete, delayed, incorrect, or out of date relative to the latest CMS release or facility status.
  • CMS star ratings, deficiency citations, fines, abuse icons, and staffing metrics have known limitations and are not a complete picture of any home.
  • Our editorial rankings and scores are not CMS products and are not endorsed by CMS or any government agency.
  • Facility names, ownership, and chain affiliations can change; always verify critical facts on official CMS or state sources.

4. No warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR AVAILABILITY. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

5. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NURSING HOME REPORTER AND ITS OPERATORS, AFFILIATES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON ANY CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted.

6. Intake forms and referrals

If you submit a case-review or eligibility form, you authorize us and our partners (including advertising, intake, and case-management vendors) to receive your information and to contact you about your inquiry as described in our Privacy Notice. Completing a form is optional and is not required to browse public CMS-derived report cards. We may share your submission with law firms or intake specialists who may evaluate whether to contact you. We do not control those third parties’ advice or decisions.

7. Acceptable use

You agree not to:

  • Scrape, harvest, or bulk-download the Site in a way that degrades service or violates law
  • Misrepresent your identity or submit false information on intake forms
  • Attempt to gain unauthorized access to admin areas, APIs, or systems
  • Use the Site to harass facilities, staff, or residents, or for unlawful purposes
  • Remove or obscure proprietary or attribution notices

8. Intellectual property

Site design, original text, rankings methodology presentation, and branding are owned by Nursing Home Reporter or its licensors. CMS and government data remain subject to applicable public-data terms. You may link to our pages for non-commercial reference; you may not republish substantial Site content without permission except as allowed by fair use or public-data rules.

9. Third-party links and services

The Site may link to CMS, Formspark, advertising platforms, analytics, or other third parties. We are not responsible for third-party sites, policies, or practices.

10. Indemnity

You agree to indemnify and hold harmless Nursing Home Reporter and its operators from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your submissions, or your violation of these Terms.

11. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Site after changes constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence apply.
